Joint Tenancy and Tenancy in Common
Legally there are two types of joint ownership (also known as joint equity or property co-buying). You can either own the property as ‘joint tenants' or as ‘tenants in common'. Do not be put off by the terminology. It has nothing to do with tenancies and applies to freehold or leasehold property.

Joint tenancy
Under this agreement the joint owners together own the whole property and do not have a particular share in it. If one of the owners dies the other automatically becomes the sole owner. This would be the case even if a will had been made leaving the deceased owner's ‘share' to someone other than the co-owner. This type of tenancy would not be appropriate for friends buying together.
Tenancy in common
This is the opposite of joint tenancy in that the tenants in common each have a definite share in the property. For example A and B could own the property in equal shares, or A could own one fifth with B owning four fifths. This would be the most appropriate agreement where people want to own a property in separate pre-determined shares.
Under this form of ownership if one of the owners dies, his share of the property will pass on to whoever he specifies in a will, or if a will is not made, in accordance with the rules of intestacy (someone dying without leaving a will). If you are planning to make a will (and it would be wise to do so) you should have it drawn up before you sign the transfer deed that passes the legal ownership of the property to you. This way you will save the time, money and inconvenience of having to change your will.

Which form of joint ownership should you opt for?
This depends upon personal choice and your particular circumstances. The joint tenancy is most commonly adopted between married couples where there is perceived to be no advantage in defining separate shares in the property and where it would be the intention that on the first death the property would automatically pass to the surviving spouse. The alternative basis of a tenancy in common will often be used between brothers and sisters, parents and children, unmarried couples, business partners and the like. In these relationships it might be desirable for specific shares in the property to be identified and for each owner to be able to leave his or her share in the property to a named person other than the owner.

Settling the financial arrangements can be a major 'flashpoint' during the divorce process - it is usually far more complex than the divorce itself. The settling of financial matters on divorce is called ancillary relief. The law in this area is very flexible to enable courts to achieve fairness depending on the individual circumstances of each case. The main piece of legislation in this area is the Matrimonial Causes Act 1973, which sets out the factors to be considered in deciding what is fair:
- the welfare of a child of the family;
- the income, earning capacity, property and resources of each person;
- the financial needs, obligations and responsibilities of each person;
- the standard of living enjoyed by the family before the breakdown of the marriage;
- the age of each person and the duration of the marriage;
- any physical or mental disability;
- the contribution made by each person to the welfare of the family, including looking after the home and bringing up children;
- the conduct of each person, but only if it is so bad it would be unfair to ignore it; and
- any serious disadvantage to either person which would be caused by ending the marriage.
Because the court has a wide discretion in applying the law, it is better to avoid the uncertainty of a court hearing. Most people are able to agree how their finances should be split with each having the help of a lawyer to advise on what might be a fair division, highlight the options for achieving this, and negotiate on their behalf.
Mediation services can also help couples reach agreement on key issues but a solicitor will be needed to advise on the implications of any agreement and convert it into an order recognised and enforceable by the courts.
The starting point must always be a full and honest disclosure of each person's personal assets, to ensure that everything is included in the 'pot' to be shared. Financial arrangements can be settled through a 'clean break', which ends the financial obligations between the couple if this is appropriate. Some form of maintenance payments may, however, be more suitable. These can be ongoing or for a fixed period. Even where there is a 'clean break' agreement maintenance will still be payable for any dependent children.
The Family Home
Often a family's main asset is the family home. Given that the needs of any children are the first consideration, it will be important to make sure that a suitable home is maintained for them. It may be that the family home can be sold with the proceeds divided between the couple (not necessarily in equal shares). The property could also be transferred to one spouse with the other receiving a greater share of other assets. A less common approach could allow one person to stay in the house with the other keeping an interest in the property, receiving their share when it is sold. This might be when the youngest child has finished full-time education.
The law has recently changed to allow a pension fund to be shared on divorce. Pension sharing will not be appropriate in all cases and, where it is an option, the fund will not always be divided equally. This is a complex area and it is highly likely that specialist financial advice will be needed on how sharing can be achieved in each individual set of circumstances.

Relationship breakdowns can affect our health. You may feel a range of powerful emotions, such as fear or uncertainty for the future, anger at your partner or yourself, sadness at the end of a phase of life, loneliness and isolation and often a sense of failure. It can be difficult to adjust to your new circumstances and this can impact on your mental health.

There are a range of services available which provide assistance and support to those experiencing relationship breakdown, separation and divorce. Family Relationship Centres are a first port of call for families seeking help. Through information and referral, the centres help families strengthen relationships and deal with relationship difficulties.
Changes to Australia's family law system introduced since July 2006 means that individuals wanting to apply to the court for a parenting order must first attempt family dispute resolution if appropriate. If family dispute resolution is not appropriate or an agreement not reached then a certificate can be obtained from a registered family dispute resolution practitioner confirming an attempt at family dispute resolution was made.
Note: There are some exceptions to this requirement, such as cases involving family violence or child abuse.
