The military justice system is a generic term which covers functions such as discipline in the Australian Defence Force (ADF), administrative action to support ADF policy, inquiries to establish facts relevant to operation and command of the ADF, and the provisions for review and management of complaints.

The system is essential to ADF operational effectiveness and it complies with Commonwealth laws. Military members are subject to the same laws as apply to other Australians. The military justice system applies to all ranks. All ADF members have an interest in the success of the system.

In 1982 the Federal Government introduced the Defence Force Discipline Act 1982 (DFDA) as a part of Commonwealth law. This law became effective in 1985, and all ADF members are subject to it.

The purpose of the DFDA is to maintain and enforce military discipline.

The discipline system is necessary for ADF operational capability by dealing with offences that affect military discipline. This includes offences that are uniquely military and other offences that occur in a military environment.

Offences by ADF members are prosecuted under the DFDA, within the military justice system, when the offence substantially affects the maintenance and ability to enforce Service discipline in the ADF. Otherwise, criminal offences or other illegal conduct are referred to civil authorities, such as the police.

The military justice system provides the ADF with an Australian legal framework able to be applied on operations anywhere in the world. This is essential because the ADF may conduct operations in countries where the civil system has broken down and no law applies.

The military justice system applies to all ADF members in times of peace and war, whether in Australia or overseas. ADF members must maintain the high level of discipline required on operations, at all times.

The discipline system includes processes for the investigation of alleged offences, preferring of charges and conduct of fair and reasonable trials.

All ADF members have access to free legal advice in the internal discipline system. This is unique to the military.
The discipline system includes safeguards such as automatic review of convictions and punishments and the right to an internal and external appeal. These safeguards are more extensive and rigorous than those available in the civilian criminal system.

Administrative system

The ADF is not the only working environment where an individual's inappropriate behaviour could lead to the death or injury of a colleague.

Like many other organisations the ADF has an administrative system to support its operations. The system includes components that allow the ADF to maintain the expected standard of professional judgement, command and leadership.
The administrative system also includes provisions to inquire into the facts of any matter.
The administrative system is intended to ensure operational effectiveness. It is not a substitute for punishment for an offence under the discipline system.

Adverse administrative action

A high standard of professional conduct is expected of all ADF members. If professional conduct falls below standard, administrative action is taken.

Administrative action includes counselling, formal warnings, censures, removal from command, and discharge from service.

Redress of grievance and other complaints

The ADF is proud of its progressive system of redress and complaints, which is among the most comprehensive anywhere.

The administrative system includes a legally protected redress of grievance provision that allows an individual to complain about any matter that affects his or her service. The ADF provides legal assistance to ADF members who wish to make a complaint.

There are a number of internal and external organisations to assist ADF members in making a redress or complaint. Usually members submit redress or other complaints through their commanding officer or chain of command. If this course of action is not appropriate then members are able to seek other avenues for complaints.

Internal organisations for dealing with complaints include:

• Fairness and Resolution Branch, and
• Inspector General ADF.

External organisations include:

• The Defence Force Ombudsman,
• Human Rights and Equal Opportunity Commission, and
• the Office of the Federal Privacy Commissioner.
In some cases, members may also seek a review of the administrative conduct or decisions, made in the ADF, by the Federal Court and higher courts.

Administrative inquiries

The administrative inquiry process is not part of the discipline system. There are different types of administrative inquiries, such as Boards of Inquiry and Investigating Officer Inquiries.

An administrative inquiry determines the facts of an event. By determining what went wrong, the ADF is able to initiate reforms that maintain operational effectiveness, prevent a reoccurrence and save lives.

An administrative inquiry is an internal process that does not place blame and incriminate members involved for offences under the discipline system.

It is important that witnesses are able to give evidence to an inquiry without fear of disciplinary action arising from their admissions. Without this, it might not be possible to get to the true causes of an incident. Openness and frankness are important to a successful inquiry.

Administrative inquiries can be conducted by either ADF personnel or civilians. A civilian may be appointed to be on a Board of Inquiry, or to be an inquiry officer.

The reports resulting from an inquiry are generally not available to the public because of privacy and security obligations. In some cases, such as reports from Boards of Inquiry and Investigating Officer Inquiries, legislation also requires Ministerial approval for public or other release of inquiry reports. These legal protections are necessary to encourage openness and frankness in the inquiry process to enable the true facts to be determined.

Administrative inquiries are essential in maintaining ADF operational effectiveness and ensuring the safety of ADF members. They are used to identify faults and improve ADF systems, procedures, training and equipment. Getting to the facts of the matter and initiating reforms is essential to ADF effectiveness.

The US Navy has commissioned the 14th Freedom-class littoral combat ship, the USS Nantucket (LCS 27), in Boston, Massachusetts. The event followed the vessel’s acceptance trials in 2022 and delivery in July 2024. That was the US Navy’s idea for the low-end backbone of its future surface combatant fleet. Inspired by successful experiments like Denmark’s Standard Flex ships, the US Navy’s $35+ billion “Littoral Combat Ship” program was intended to create a new generation of affordable surface combatants that could operate in dangerous shallow and near-shore environments, while remaining affordable and capable throughout their lifetimes. In January 2007, the big question was whether there would be a competition for the USA’s KC-X proposal, covering 175 production aircraft and 4 test platforms. The total cost is now estimated at $52 billion, but America’s aerial tanker fleet demands new planes to replace its KC-135s, whose most recent new delivery was in 1965. Otherwise, unpredictable age or fatigue issues, like the ones that grounded its F-15A-D fighters in 2008, could ground its aerial tankers – and with them, a substantial slice of the USA’s total airpower. Americas Swedish defense contractor Saab has made an offer for the sale of its JAS 39 Gripen light supersonic aircraft to the Republic of Colombia. The potential contract of an undisclosed number of Gripens with Bogotá was first revealed unofficially by Swedish public news agency Sveriges Radio, according to a report by Reuters. In a recent interview, Saab CEO Micael Johansson confirmed this, saying that the Stockholm-based company committed to a “full-fledged” proposal to the Latin American country. The US Army has awarded Florida-based Repkon a $435-million contract to develop and commission a TNT factory in Muhlenberg County, Kentucky. TNT is used for ammunition and explosives in the military, including the commonly used 155-millimeter artillery shells.  The announcement was made by Senator Mitch McConnell, who noted that the future center to be established at Muhlenberg County will be America’s first local TNT source since the 1980s. But the helicopters are wearing out. Fast. The pace demanded by the Global War on Terror is relentless, and usage rates are 3 times normal. Attrition is taking its toll. Over the past few years, CH-53s have been recalled from “boneyard” storage at Davis-Monthan AFB in Tucson, AZ, in order to maintain fleet numbers in the face of recent losses and forced retirements. The agreement will provide the framework for developing autonomous surface and aerial defense systems that meet the needs of Brasília’s naval forces.  Brazilian Navy Admiral Edgar Luiz Siqueira Barbosa and EDGE Managing Director and CEO Hamad Al Marar formalized the agreement at the Euronaval defense exhibition in Paris. The US Defense Advanced Research Projects Agency (DARPA) has awarded RTX’s BBN Technologies to develop a tool to boost its digital defenses.  The contract supports DARPA’s Compartmentalization and Privilege Management (CPM) program, which aims to prevent the escalation of initial cyber threats into a full-blown attack while maintaining system efficiency. In response, the Americans rethought the armored personnel carrier, taking a page from the Soviet book. They created a more heavily armored, faster “Infantry Fighting Vehicle” named after WW2 General Omar “the soldier’s general” Bradley, and gave it an offensive punch of its own. M2/M3 tracked, armored IFVs can carry infantry – but they also have 25mm Bushmaster cannons, networked targeting sensors, and even TOW anti-armor or Stinger anti-aircraft missiles at their disposal. Americas BAE Systems won a $122 million deal for systems engineering and integration support services and special studies in support of the US Trident II (D5) Strategic Weapon System Program and D5 Life Extension 2 Strategic Systems Programs Alteration. Tasks to be performed include systems engineering and integration, test engineering, data analysis, and safety engineering. Work is expected to be completed September 30, 2027. Strategic Systems Programs, Washington, DC, is the contracting activity. The US Navy has contracted Leonardo DRS to produce, inspect, and test ship-based air and surface target detection AN/SPQ-9B radars.  The potential five-year contract could amount to $235 million if all options are exercised. “The SPQ-9B radar is a vital ship protection system used across the fleet, and we are proud that the US Navy continues to entrust us to produce this important defensive technology,” senior vice president of the Leonardo DRS Naval Electronics business unit Cari Ossenfort said. Trident IITrident II D5 Test Launch (click to view full) Nuclear tipped missiles were first deployed on board US submarines at the height of the Cold War in the 1960s, to deter a Soviet first strike. The deterrence theorists argued that, unlike their land-based cousins, submarine-based nuclear weapons couldn’t be taken out by a surprise first strike, because the submarines were nearly impossible to locate and target. Which meant that Soviet leaders could not hope to destroy all of America’s nuclear weapons before they could be launched against Soviet territory. SLBM/FBM (Submarine Launched Ballistic Missile/ Fleet Ballistic Missile) offered shorter ranges and less accuracy than their land-based ICBM (Inter-Continental Ballistic Missile) counterparts, but the advent of Trident C4 missiles began extending those ranges, and offering other improvements. The C4s were succeeded by larger Trident II D5 missiles, which added precision accuracy and more payload. The year that the Trident II D5 ballistic missile was first deployed, 1990, saw the beginning of the end of the missile’s primary mission. The Peruvian Air Force has received the first of two Beechcraft King Air 360C air ambulance aircraft for medical evacuation missions. Acquiring the jets will strengthen the country’s light transport, aeromedical evacuation, disaster response, and risk management capabilities. Under the agreements, the USA would end production at 3 Graf Spee sized DDG-1000 Zumwalt Class “destroyers,” but shift all production from the Congressionally-mandated joint arrangements to General Dynamics Bath Iron Works in Maine, which had already made program-related investments in advanced shipbuilding technologies. Northrop Grumman (now Huntington Ingalls Industries) would retain its DDG-1000 deckhouse work, but their main exchange was additional orders for DDG-51 Arleigh Burke Class destroyers. Their Ingalls yard in Pascagoula, Mississippi would continue building the DDG-51 destroyers, beginning with 2 ordered in FY 2010-2011. Full awareness of what is going on around them, and the ability to push that awareness well offshore, are critical security requirements. “Project Wedgetail” had 3 finalists, and the winner was a new variant of Boeing’s 737-700, fitted with an MESA (multirole electronically scanned array) radar from Northrop Grumman. That radar exchanges the traditional AWACS rotating dome for the E-7A’s “top hat” stationary antenna.
